Under the U.S.–Romania tax treaty, Article 7 (“Business Profits”) applies to our software sales. This means that, as a Romanian tax resident with no permanent establishment in the United States, our business profits are taxable only in Romania. As a result, the treaty withholding rate is 0%, and U.S. payers are not required to withhold U.S. tax on payments for our products.
